3R Net General Terms and Conditions

The Web Site: http://www.forestgreen-wasp-355649.hostingersite.com (the “Site”) is owned and operated by 3R Net Limited. (“3R Net”).

Use of the Site

When completing a product enquiry form you need to provide 3R Net with accurate and complete information to allow us to provide you with the product details you have requested. It is your responsibility to inform 3R Net of any changes to the information you supplied (including in particular your e-mail address) by e-mailing customer services.

The Site and the 3R Net Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or intellectual property right used without proper authorisation, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

Intellectual Property

All images, text, programs, and other materials found on the Site belong to 3R Net or its licensors and are protected by appropriate copyright laws. You may retrieve and display Content from the Site on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your personal, non-commercial use. Any commercial use of the images, text, programs or other materials found on the Site is strictly prohibited, without the express written consent of 3R Net.

Content

The Content is only for your general information and use and is not intended to address your particular requirements. In particular, the Content does not constitute any form of advice, recommendation or arrangement by 3R Net and is not intended to be relied upon. 

While all reasonable attempts are made to ensure the accuracy of the information, neither 3R Net, nor its information contributors can be held responsible for the accuracy of the information found on the Site. 3R Net makes no expressed or implied warranty as to the accuracy of Content or programming. 

Changes

3R Net reserves the right, at its discretion, to make changes to any part of the Site. Due to its policy of updating and improving the site, 3R Net may wish to change these Terms (including those relating to your use of the Content). When terms are changed, 3R Net will notify you by e-mail or by publishing details of those changes by including them at the end of these Terms. If you use the Site and 3R Net has published or notified you of the changes, you are agreeing now to be bound by those changes.

Privacy of Data

Certain areas of the Site allow for the exchange of information between you, and 3R Net and you implicitly grant 3R Net the authority and right to use that content in accordance with 3R Net Privacy Policy.

Third-Party Sites

Sites or pages which are linked to the Site are for information only, they have not been reviewed by 3R Net. 3R Net has no responsibility for the content of sites or pages linked or linking to the Site and 3R Net accepts no responsibility or liability for any losses or penalties whatsoever that might be incurred as a result of linking to any location on any linked sites or pages. 

Links do not imply that 3R Net or the Site sponsors, endorses or is associated with, or is legally authorised to use any trademark, trade name, logo or copyright symbol displayed in or accessible through the links, or that any linked site or page is authorised to use any trademark, trade name, logo or copyright symbol of 3R Net or any of its subsidiaries or their parent companies.

Limitation of Damages

In no event will 3R Net or any of its subsidiaries or their parent companies be liable to you for any direct, special, indirect, consequential, incidental damages or any damages of any kind even if 3R Net has been advised of the possibility thereof. (Applicable law may not allow the limitation or exclusion of liability for consequential or incidental damages, so the limitation or exclusion may not apply to you.)

International Users and Choice of Law

The Site is not directed at any person in any jurisdiction where for any reason the publication or availability of the Site is prohibited. Those in respect of whom such prohibitions apply must not access the Site. 

3R Net does not represent that any of the materials or information at the Site are appropriate for use or permitted by local laws in all jurisdictions. Those who access the Site do so by their own initiative and are responsible for compliance with applicable laws and regulations. Legal advice should be sought in cases of doubt.

The terms and conditions are governed by and shall be construed in accordance with the laws of England and Wales.

3R Net Limited Standard Terms and Conditions of Business

This document sets out the Terms and Conditions governing the agreement between the Customer and 3R Net Limited ( “3R Net ” ) of P.O. Box 42599, London, E1W 3LA.

1. Interpretation

1.1. In this contract the following interpretations apply: “We” and “us” means 3R Net Internet, “The Client”, “he”, “his” and “him” means the customer we make this Contract with. It includes a person who we reasonably believe is acting with the customer’s authority or knowledge; “Contract” means the agreement between us and the Client, incorporating these Terms and Conditions and the relevant Purchase Order Form; “Purchase Order Form” means the relevant order paperwork, specific to each product and service, which must be signed by the Client prior to commencement of the Service; “Information” means the visual, textual or other information published or otherwise made available (directly or indirectly) on the Internet using the Service; “the Internet” means the global data network comprising interconnected networks using TCP/IP (“Transmission Control Protocol/ Internet Protocol”); “Name” means any name specifically requested by or allocated to the Client for the provision of the Service; “the Service” means the service provided by us whereby the Client can gain access to the Internet and, where applicable, any services and facilities which we provide and the Client uses in connection with the Service and which are set out on the relevant Purchase Order Form.

2. Provision of the Service

2.1. We agree to provide the Client with the Service under the terms and conditions of this Contract. 
2.2. 3R Net’s Services are provided on an ‘as is’ and ‘as available’ basis and we make no warranties or representation, whether express or implied, in relation to 3R Net or the Services. 
2.3. The Service is accessed via a telecommunications service. This Contract does not include the provision of telecommunication services necessary for connection to the Service. The Client is responsible for making a separate application for the appropriate service and for complying with the conditions applicable to it. 
2.4. The Client is responsible for providing a suitable PC, modem and any other items of hardware or communications equipment necessary to enable them to access the Service. 
2.5. 3R Net reserves the right to vary the technical specification of the Service from time to time. 
3. Minimum subscription period. 
3.1. The minimum subscription period for provision of Service is twelve calendar months, every twelve months. Please note that certain products and services are subject to specific terms and conditions. These are included on the relevant Purchase Order Forms and acceptance correspondence. The relevant documents must be signed by the Client prior to commencement of service.

4. Charges

4.1. The Client agrees to pay all charges for the Service as specified in the Price List and the relevant Purchase Order Form. 
4.2. Unless otherwise specified in the Price List, all charges are payable in advance. 
4.3. All charges quoted to the Client are exclusive of VAT for which they shall be solely liable at the applicable rate. 
4.4. All invoices must be paid by their due date. In the event of default on payment by the Client, 3R Net shall then have the right to require them to pay all sums due on demand. 
4.5. Without prejudice to the foregoing provision, 3R Net reserves the right to terminate the Services to the Client forthwith in the event of any default on payment. Accounts in default may be charged interest on the outstanding balance at a daily rate of 3% above the National Westminster Bank plc’s base-lending rate. 
4.6. In the event of non-payment by the Client, 3R Net reserves the right to retain all Services including but not limited to domain names, until such time as all monies due and owing have been paid. 

5. Security

5.1. In order to access the Service the Client will be issued with a user name and password. It is the Client’s responsibility to ensure that all passwords are kept confidential, secure, used properly and not disclosed to other people. 
5.2. It is the Client’s responsibility to inform us immediately if the password has become known to someone not authorised to use it or if any password is being used or is likely to be used in an unauthorised way. 
5.3. If we have reason to believe that there is likely to be a breach of security or misuse of the Service, we may change the Client’s password and notify them accordingly. 
5.4. The Client agrees to provide us promptly and accurately with all the information that we may reasonably require in order to carry out our obligations under this agreement, and to notify us immediately of any changes. 

6. Use of the Service

6.1. The Service may not be accessed or used more than once at any given time. 
6.2. The Client is responsible for the creation, maintenance and design of all Information on any web site they may establish. 
6.3. The Client warrants that the Information will not include any material which is (or the accessing of which) would be a criminal offence or otherwise unlawful. In particular, the Client warrants that all necessary licenses and consents have been obtained. 
6.4. The Client warrants that they will comply with all consumer and other legislation, instructions or guidelines issued by regulatory authorities, relevant licenses and any other codes of practice which relate to the provision of Information and which apply to them. 
6.5. The Service must not be used: 
6.5.1. Fraudulently or in connection with a criminal offence. 
6.5.2. To send, receive, upload, download or use any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of copyright, confidence, privacy or any other rights 
6.5.3. To send unsolicited advertising or promotional material. 
6.5.4. To cause annoyance or inconvenience; or 
6.5.5. In contravention of 3R Net’s Acceptable Usage Policies (AUP). 
6.6. The Client must not use a Name so as to infringe the rights of any person in a corresponding trademark or name. 
6.7. The Client must tell us immediately if any third party makes or threatens to make any claim or issue legal proceedings against them relating to their use of the Service. 
6.8. If we suspend the Service for contravention of any of paragraphs 6.1 to 6.6 inclusive, we will not restore it until we receive an acceptable assurance from the Client that there will be no further contravention. 

7. Assignation

7.1. The Client shall not assign, re-sell, transfer or sub-lease the Services or their rights under this agreement. 
7.2. 3R Net shall be entitled to assign this agreement either in whole or in part. 

8. Breach of Contract

8.1. 3R Net reserves the right to suspend provision of the Service to the Client or terminate this Contract (or both) with immediate effect if: 
8.1.1. The Client breaks any provision of this Contract. 
8.1.2. We reasonably believe the Service is being used in a manner prohibited under paragraphs 6 or 7.1. 
8.1.3. Any charges for the Service are unpaid or rejected; or d) Bankruptcy or insolvency proceedings are brought against the Client or a receiver or administrator is appointed over any of the Clients assets or the Client goes into liquidation. 
8.2. If we terminate this Contract under 8.1 the Client must pay us all charges, which are due for the Service under this Contract, including any unpaid charges for the remainder (if applicable) of the Minimum Subscription Period. 
8.3. The Client will continue to be liable to pay all charges due for the Service during any period in which they fail to comply with this Contract, including for any period when the Service is suspended. 
8.4. If we delay in acting upon a breach of this Contract by the Client, that delay will not be regarded as a waiver of the breach. If we waive a breach of this Contract by the Client, that waiver is limited to that particular breach. 

9. Termination of Contract 

9.1. At any time after the Service has been provided, this Contract or the provision of any service or facility under it may be ended by 30 days written notice on either side. 
9.2. If the Client gives notice they agree to pay charges for the Service until the expiry of the notice. The Client must also pay the charges due for any remaining part of the Minimum Subscription Period. 
9.3. If we give notice to end the Service under paragraph 9.1, the Client agrees to pay the charges for the Service until the expiry of the notice period and we will repay or credit the appropriate proportion of any charges for the Service which the Client has paid in advance for a period ending after the notice expires. 
9.4. Notice being given does not avoid any other liability for the Service already provided.

10. Liability 

10.1. Although the Client may use the Service to link into other Internet Networks, we cannot be and are not responsible in any way for any telecommunications systems or networks which we do not operate. 
10.2. We do not accept liability for death or personal injury caused by our negligence. 
10.3. In performing any duty under this Contract, our duty is only to exercise the reasonable care and skill of a competent Internet Service Provider. 
10.4. The Client acknowledges that we have no control over the information which can be accessed using the Service and that we do not examine the use to which Clients put the Service or the nature of the information they are sending or uploading. We exclude all liability of any kind for the transmission or reception of such information of whatever nature. 
10.5. We exclude all liability for the information or any other material published or otherwise made available by the Client or any other person on any web site established using the Service. 
10.6. We are not liable whether in contract, tort (including liability for negligence) or otherwise for the acts or omissions of other providers of telecommunication services or for faults in or failures of their apparatus. 
10.7. We are not liable in contract tort or otherwise (including liability for negligence) for loss whether direct or indirect of business revenue or profits, anticipated savings or wasted expenditure, corruption or destruction of data or for any indirect or consequential loss at all. 
10.8. Each provision of this paragraph 10 operates separately in itself and survives independently of the others. 

11. Indemnity

11.1. The Client must indemnify us against any claims or legal proceedings arising from the use of the Service under this Contract (including but not limited to claims in respect of defamation, breach of copyright or other intellectual property right infringement) which are brought or threatened against us by another person. 

12. Variation of Terms and Conditions

12.1. We reserve the right to vary these Terms and Conditions at any time after giving reasonable notice. 

13. Force Majeure

13.1. We shall not be liable for failure of the Service caused by circumstances beyond our control. This includes, but is not limited to; acts of God, fire. Lightning, explosion, war, flood, industrial disputes, sabotage, severe weather conditions or acts of local or central Government or any other competent authorities. Should any instance of Force Majeure continue for more than 90 consecutive days, then either party shall be entitled to terminate this agreement forthwith. 

14. Notice

14.1. Notices given under this Contract may be sent via fax, or by first-class pre-paid post to the addressee at the following address: 
14.2. To us: 3R Net Limited, P.O. Box 42599, London, E1W 3LA or any alternative address which we notify to you at any time. 
14.3. To the Client: the address which the Client specifies when registering for the Service, any alternative address which they notify to us at any time or, if the Client is a limited company, their registered office. 

15. Name

15.1. You confirm and warrant that you are the owner of or that you are duly authorised by the owner to use any trade mark or name requested or allocated as your Name. 
15.2. You acknowledge that we cannot guarantee that any Name you request will be available or approved for use. 
15.3. We reserve the right to require you to select a replacement Name and may suspend the Service if, in our opinion, there are reasonable grounds for us to believe that your current choice of Name is, or is likely to be, in breach of the provisions of paragraphs 6.5 or 6.6. 

16. Third Party Rights

16.1. A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract. 

17. Law/Jurisdiction

17.1. This Contract is governed by English Law and the Client and 3R Net submit to the exclusive jurisdiction of the English Courts. 

3R Net Acceptable Use Policies

Please read these Acceptable Use Policies (“AUPs”) and the Terms and Conditions.

General

By using our services, you agree to comply with these Acceptable Use Policies, and we may terminate your account if you fail to comply with these guidelines. These AUPs are common sense guidelines for use of the Internet and are designed to allow all users to enjoy use of it.

Interpretation

The following policy is intended to be a guideline to 3R Net’s stance against violations of the accepted norms of the Internet community and is not intended to be exhaustive. We reserve the right at all times to protect our reputation and goodwill. 

Web Space

1. The customer is restricted to an amount of web space in Mb that is purchased. It is the customers’ responsibility to ensure that his/her disk usage does not go over this limit.

2. The customer must not disclose his/her password to any third party.

3. The customer is not permitted to use any server-side cgi or other program other than those placed by 3R Net into the main cgi-bin directory without prior consent from 3R Net.

4. The customer is responsible for keeping backups of all his/her own data. 3R Net will not be responsible for loss of customer’s data for any reason.

5. The customer is responsible for ensuring that the data offered in their web space does not break any UK law or any law in the home country of the customer. 3R Net reserves the right to remove a site or any section of a site under any of the following circumstances:

  • The material is suspected to be illegal.
  • The site gets an abnormally high number of hits.
  • The site contravenes point 3 stated above.
  • The customer closes their account or the customer’s account is suspended.
  • The presence of the site adversely affects in any way the ability of 3R Net to provide its services to other customers.

6. The customer must not resell his/her web space.

7. The customer must not use his/her web space to store or provide access to pirate software of a third party’s products or services, including providing commercial links or adult verification systems.

8. The customer must not promote his/her web space in such a way that he/she would breach this policy, whether through 3R Net or an alternative Internet Service Provider.

9. Any content of an adult nature must contain a warning page as to the content of the site that should be displayed prior to the viewing of any such adult content.

Email and Newsgroups

10. The customer must not use 3R Net’s service for any of the following purposes:

  • Initiating or propagating ‘chain’ email or ‘pyramid’ emails.
  • Sending bulk or unsolicited emails, especially of a commercial nature.
  • Using their 3R Net account as a mail-collector for responses for any of the above.
  • Sending any other email that may reasonably be considered spam mail.

11. The customer must not email a person after they have specifically requested that you do not mail them. This applies to any automated mail system you employ.

12. The customer must not send email or post articles with headers modified in such a way as to disguise the true source of such mail or article. It is the customer’s responsibility to ensure that a real email address is present and obvious to a human.

13. The customer must not post articles of a commercial nature to groups that are inappropriate to the subject of the article. This covers ‘spamming’.

14. The customer must not use the service to post articles that contravene the charter of the group to which the posts are made. This includes binary attachments being posted to non-binary newsgroups.

15. The customer must ensure that his or her equipment cannot be used to relay mail for a third party. Failure to comply may result in suspension of service without prior notice.

Miscellaneous

16. The customer must not use their account for the purpose of obtaining unauthorised access to any computer or service.

17. The customer is responsible at all times for use of the account, whether through the customer or through third parties.

18. 3R Net reserves the right to remove any Usenet articles or web sites that might be held to be defamatory at its sole discretion.

19. Customers purchasing a single user account must note that this type of account implies single concurrent usage and must not, via tunnelling, use of proxies or by any other means, attempt to avoid the service restrictions imposed on this account type.

Breaches

20. Following a breach of the AUP, 3R Net will take any action it considers to be appropriate up to and including closure of the account without notice. All breaches will be reviewed on a case-by-case basis.

21. Following suspension of a customer’s account, the customer must send a letter to 3R Net undertaking not to breach this Policy on a subsequent occasion before the account will be reinstated.

22. 3R Net does not allow credits or refunds for any outages resulting from a suspension or deletion of an account under this policy.

23. 3R Net reserves the right to modify or amend this Policy at any time. Any breaches of this Policy should be reported to abuse@forestgreen-wasp-355649.hostingersite.com and the entire posting, together with the full headers, should be forwarded. Although it is not always possible to respond to each abuse report, all complaints will be investigated thoroughly.

24. 3R Net’s assignment of IP address space is valid as long as the criteria for the original assignment are met and remain valid only for the duration of the contractual agreement between customers and 3R Net who have at all times the right to reassign the IP address space to another user upon completion and / or termination of the agreement or a written mutually agreed period thereafter.  For the avoidance of doubt this means that the customer is required re-configure the addresses of all equipment using 3R Net’s IP address space if you continue to require global uniqueness of those addresses. Note that some Internet services do not require globally unique addresses if accessed through a network address translator or application layer gateway and / or Internet firewall.

3R Net Dial-Up and Global Roaming Internet Access T&Cs

Orders will not be processed without signed agreement to these product specific terms and conditions, in addition to our Standard Terms and Conditions.

The customer specifically understands and agrees to each of the following: 

1. Single Access Accounts 

a. I understand that this is a single access account and that if I try to authenticate simultaneous users I will be in breach of the 3R Net Terms and Conditions. 
b. I understand that the minimum contract time is twelve months, every twelve months, and that failure to notify 3R Net a minimum of one month prior to the commencement of a new twelve month period will render me liable for that twelve month period. 
c. I understand that I should never disclose any of my passwords to a third party. Should I require a third party, such as a Technical Consultant to have access to my account then 3R Net will supply the password to the third party on receipt of a request in writing on company headed paper.

2. Routed Solutions 

I understand that 3R Net will hold all router access passwords if such a device is supplied. Should I require these details then I agree to take full responsibility for any problems that may arise due to configuration of the router, and may be liable for time related charges for technical support on this device if required. 

3. Fixed IPs 

IP address allocations are valid as long as the criteria for the original assignment are met and remain valid only for the duration of the contractual agreement between customers and 3R Net who have at all times the right to re-assign the IP address space to another user upon completion and/or termination of the agreement or for the technical reasons giving three month’s notice. 

4. GRIC 

a. I understand that I will be liable for any additional charges incurred through the usage of the GRIC global roaming facility, and that these charges will be debited from my credit card.  I will supply a PO to authorize these charges.  I understand that while in the UK I should not access the Internet through the GRIC Dialler or I will be liable for additional charges. 
b. I understand that 3R Net cannot be held liable for any connectivity failures or failures in the provision of service by other GRIC alliance members. 
c. I understand that if I would like any usernames, password changes (specifically for roaming accounts, but not exclusively), that I may be liable to an administration charge.  Please contact your account manger for details. 
d. I understand that whilst connecting abroad with GRIC I should contact the Technical Support Department of the ISP I am connecting with if I have problems. (Please note that whilst using the global roaming facility, you will be liable to call charges at the local rate in the country that you are connecting.  3R Net will bill you quarterly 20 pence per connection and 6 pence per minute connected whilst online). 
e. I understand that the prices quoted on this form for roaming access are correct at the time this form is dispatched, and that these charges may vary over time. 

By agreeing to abide by the Terms and Conditions and Acceptable Usage Policies of 3R Net. The conditions of payment and contract times as indicated above are in addition to the Standard Terms and Conditions. 3RNet Domain Name Registration and Domain Name 

Additional T&Cs 

By registering a .uk domain name, you enter into a contract of registration with Nominet UK on the following terms and conditions.

By registering any other domain name, you enter into a contract of registration with Verisign, Inc. on the following terms and conditions

These terms and conditions are a separate contract to any arrangement you may have with Atlas Internet or any other third party for the provision of Internet services. 

Please read these before proceeding with your order.

3R Net SMTP Mail Feed Terms and Conditions

Orders will not be processed without signed agreement to these product-specific terms and conditions, in addition to our Standard Terms and Conditions.

The customer specifically understands and agrees to each of the following:

  1. To ensure that a customer technical contact will need to liaise with the 3R Net when this service is set up, and that this contact has a good working knowledge of SMTP and Internet Mail. Furthermore, to be additionally invoiced if we provide excessive or extensive set-up support during this time. (3R Net will advise of charges prior to and at the time of that support being delivered) 
  2. To a minimum contract duration of one year every year, and that failure to notify 3R Net to a intention to discontinue services at least one month prior to the automatic renewal of a new contract duration will incur the full liability for this new period. 
  3. That 3R Net are not responsible for any loss of mail resulting from the transfer or registration of any domain. 
  4. That mail account(s) are not to be used for the sending of bulk or unsolicited emails for any reason whatsoever, and failure to comply and / or adhere to this term will automatically result in service suspension without further notice. 
  5. Not to send email or post articles with headers modified in such a way as to disguise the true source of any communication, and to ensure that a real email address is present and obvious to a human. 
  6. Not to email any person who has specifically instructed or requested otherwise. This applies to any automated mail system utilised. 
  7. That if new, additional, or other amendments are required to mail mapping or aliases subsequent to the initial set-up, additional charges may apply. 
  8. Not to relay mail on behalf of any third party under any circumstances whatsoever, failure to comply and / or adhere to this term will automatically result in service suspension without further notice. 
  9. That SMTP mail feeds are normally set-up Monday to Thursday only, and that if I require a specific day(s) for any mail changeover that this will be mutually agreed in advance. 

By signing I agree to abide by the Terms and Conditions and Acceptable Usage Policies of 3R Net. The Conditions of payment and contract durations as indicated above are in addition to the Standard Terms and Conditions. 3R Net FTP and WWW Product Specific Terms and Conditions 

Orders will not be processed without signed agreement to these product-specific terms and conditions, in addition to our Standard Terms and Conditions.

The customer specifically understands and agrees to each of the following:

  1. Not to go over and above the pre-purchased limit, the service is restricted in the amount of web space in Megabytes and ftp bandwidth in Gigabytes transferred per year to only that purchased, if this agreed limit is exceeded then the customer becomes liable for all additional costs, as per 3R Net’s standard pricelist. 
  2. Not use the space to store or provide access to pirate software of a third party’s products or services, including commercial links or adult verification systems. 
  3. Not to allow access to any content of an adult nature without displaying on the site a warning page as to the exact content of the site. 
  4. Not to use any server-side CGI or other program(s) other than those specifically placed by 3R Net into the main cgi-bin directory without the specific prior written and signed consent of 3R Net. 
  5. Not to resell web space to any third party. 
  6. Not to disclose any 3R Net password to a third party. Should a requirement for a third party, (such as a web designer) to access the site; then 3R Net will supply the password directly to the party and only after receipt of a specific request made in writing on company letter headed paper. 
  7. To be responsible for keeping backups of all data, and that 3R Net is not responsible for loss of data howsoever caused. 
  8. To ensure that data offered in web or ftp space does not break any UK, or EC laws or any applicable law in the customers home country, and to acknowledge full responsibility for ensuring the same. 
  9. That 3R Net are not responsible for any downtime resulting from the transfer or registration of a domain name outside of our control. 
  10. That any GUI / log file statistics for my site are provided as a free service and errors and omissions are accepted.
  11. All prices quoted are exclusive of VAT at 17.5% – VAT must be added onto to all standing order mandates.

In taking environmental aspects into consideration, 3R Net prefers to purchase supplies from those suppliers who respect the environment.  Specifically, we look for suppliers that carry the sign of the swan (or other environmental guarantees).

3R Net regularly informs and involves all employees in its environmental work so that they can act in an environmentally responsible manner.  An example of this is the encouragement of using public transport or walking wherever possible.  In addition, we reduce our paper consumption as far as possible through the use of email and Internet technology.
